Agnello was previously granted a two-month reprieve from his 15-month prison term specifically to facilitate the transplant. However, the procedure, originally scheduled for August 3, was postponed after Victoria Gotti developed a serious infection requiring intensive antibiotic treatment. Following this delay, Agnello’s legal team requested a further extension to September 18, but the court has now drawn a definitive line in the sand.
Judge Nusrat J. Choudhury ruled that Agnello may remain at liberty until September 18 only if the transplant occurs by the Monday deadline. Should the surgery fail to take place, he is ordered to surrender to federal authorities by 2 p.m. that same day.
